1. Definitions
- "Agreement" — these Terms & Conditions, together with any engagement letter or fee agreement entered into between Chinda Law and a Client.
- "Chinda Law" / "we" / "us" — the legal practice operating at 16 Dibuk Road, Talat Yai, Phuket 83000, Thailand.
- "Client" / "you" — any individual or entity that engages Chinda Law for legal services or uses this website.
- "Services" — inheritance and estate legal services, including will consultations, estate and succession planning, and probate representation.
- "Website" — the site accessible at chindala.blog.
2. Acceptance of Terms
By using this website or submitting an enquiry, you confirm that you are at least 18 years of age and have the legal capacity to enter into an agreement. These terms apply to all use of the website and all engagements of our legal services.
A formal legal engagement is created only when both parties have signed an engagement letter setting out the scope of work and fees. Use of the website alone does not create a legal relationship.
3. Service Description
Chinda Law provides legal services in the area of inheritance and estate law in Thailand. Our three primary services are:
- Wishes & Will Consultation — drafting and advising on Thai wills
- Estate & Succession Planning — preparing succession plans and documentation
- Probate & Estate Representation — managing probate proceedings and estate administration
Services are delivered from our office in Phuket, Thailand. We advise on Thai law only. Clients with assets in other jurisdictions should seek additional advice from lawyers qualified in those countries.
4. User Responsibilities
When using our website or engaging our services, you agree to:
- Provide accurate and complete information when completing forms or submitting documents.
- Not use the website for any unlawful purpose or in a way that infringes the rights of others.
- Not attempt to access restricted areas of the website or interfere with its operation.
- Promptly inform us of any changes to information that may affect your matter.
5. Intellectual Property
All content on this website — text, design, structure, and branding — is the property of Chinda Law and protected under applicable Thai intellectual property law. You may not reproduce, distribute, or modify website content without written permission.
Legal documents prepared for you as part of an engagement remain the property of Chinda Law until fees are paid in full, at which point copyright in those documents passes to you.
6. Payment Terms
All fees are stated in Thai Baht (฿). Fixed fees for will consultations (฿4,600) and estate planning (฿10,200) are due on or before completion of the service. For probate representation (from ฿17,300), fees are phased and stated in writing at each stage before work proceeds.
Payment may be made by bank transfer or in cash at our office. A receipt will be issued for all payments.
Fees are non-refundable once work has commenced, except where Chinda Law has been unable to deliver the agreed service due to our own default. We do not offer refunds based on dissatisfaction with a legal outcome.
7. Service Delivery and Scope
The scope of each engagement is set out in the relevant engagement letter. Any additional work outside that scope will be discussed and agreed in writing before being carried out.
Timelines for will drafting and planning work are generally within 5–10 business days of the consultation. Probate timelines vary by case and are dependent on court processes outside our control. We provide realistic estimates and keep clients informed.
We maintain confidentiality in relation to all client matters. Information shared during an engagement will not be disclosed outside the practice without your consent, except where required by law.
8. Disclaimers
Legal advice is provided based on Thai law as it stands at the time of the engagement. We cannot account for subsequent changes in legislation or court interpretation.
Information on this website is provided for general reference only and does not constitute legal advice. Specific advice requires a formal engagement.
We make no representations that the outcome of any legal proceeding or estate matter will be as a client might wish.
9. Limitation of Liability
To the extent permitted by Thai law, our liability for any claim arising from the provision of legal services is limited to the fees paid for the relevant engagement. We are not liable for indirect, consequential, or incidental loss.
We are not liable for delays caused by circumstances beyond our reasonable control, including court delays, third-party inaction, or changes in law.
10. Indemnification
You agree to indemnify Chinda Law against any claims, losses, or costs arising from your provision of inaccurate or incomplete information, or from your breach of these Terms.
11. Termination of Engagement
Either party may terminate an engagement on written notice. Where a Client terminates before completion, fees for work already performed will remain payable. Where Chinda Law terminates due to a client's breach, the same applies.
Confidentiality obligations and intellectual property provisions survive termination of any engagement.
12. Dispute Resolution and Governing Law
These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, the parties agree first to attempt informal resolution by written communication.
If a dispute cannot be resolved informally within 30 days, it shall be subject to the exclusive jurisdiction of the courts of Phuket Province, Thailand.
13. General Provisions
- Entire Agreement: These Terms, together with any signed engagement letter, constitute the entire agreement between the parties in relation to the relevant engagement.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any term does not constitute a waiver of the right to do so later.
- Assignment: You may not assign your rights or obligations under these Terms without our written consent.
14. Changes to These Terms
We may update these Terms from time to time. The updated date will be shown at the top of this page. Continued use of our website after a change constitutes acceptance of the revised terms. Ongoing legal engagements are governed by the terms in place at the time of the engagement letter.
